How It Works – Uncontested Divorce in Houston
- Free Initial Phone Consultation
We begin with a consultation to determine whether you and your spouse are able to cooperate and reach an agreement on the terms of your divorce. If so, your case may qualify for a simpler, more affordable process.
- Flat Fee Agreement
For an uncontested divorce, you will only pay one flat legal fee that covers everything, including filing expenses, so that you know the total cost up front.
- Provide Case Information
You will provide detailed information about your situation, including property, children (if any), and the terms that you and your spouse have agreed upon.
- Petition Filed
We prepare and file the Petition for Divorce with the court to officially begin the case.
- Spouse Signs Initial Paperwork
We send you documents for your spouse to sign, such as a waiver of service, to keep the case simple and your costs down.
- 60-Day Waiting Period
Texas law requires a minimum 60-day waiting period after the case is filed before a divorce can be finalized.
- Final Agreed Divorce Decree
We prepare the final agreed divorce decree reflecting the terms that you and your spouse have agreed upon. You and your spouse review and sign, if approved.
- Finalization
In some cases, the court may require a brief hearing to finalize the divorce, either remotely or in-person at the courthouse. We will attend the hearing with you. In other cases, the court simply signs the divorce decree.
